On 30 September 2009 I was arrested for "child abuse" for spanking my son, which was later dropped after a DCF investigation, that I had to get initiated, cleared me. My son is ADHD, and was not taking his medicine. But that is another issue.
I am making a claim because while in the holding cell awaiting first appearance, where it was overcrowded, I was made to fall when the door was opened due to the overcrowding, and due to being in restraints that were not designed for someone my size. I landed on my knee and twisted it and my back.
I informed the officers who told me to report the injury to the tier officer, which I did. When I did I was, much later that day, given a medical request form, which I filled out. I was seen almost a week later, despite making daily attempts to get medical attention.
When I was finally seen by a nurse on "sick call" and I was given three days worth of an Advil type medication. I asked to be seen by a doctor, but was told that was not policy.
A week later, after more medical requests and inmate requests, I was seen by a nurse again, given three more days worth of Advil type medication, and she then referred it to a doctor. Just shy of three weeks after the fall and injury I was finally seen by a doctor, Dr. Ortiz, who diagnosed it as a sprain and possible ligament damage. I asked for an MRI but told that was not an option. I was placed on an anti-inflammatory.
Also, on a Tuesday I noticed a staph infection on my leg developing. I informed the tier officers and made medical requests. I was finally sent upstairs to M-2 medical wing by Officer Carson on Friday night, who took the matter seriously. I was seen by a nurse who gave me two anti-biotics and was sent back to my housing assignment.
It took three days, not until next Monday night, before the anti-biotics were administered on medication rounds.
Inbetween this I was given a medical exam and had blood drawn, and both times informed the medical staff that I had a knee injury and the staph, but that was ignored, except that during the exam the final nurse did attempt to have me called back to be seen, but that did not occur.
I was released with no charges being filed (charges dropped) three weeks, two days after my arrest, and went to the ER at Baptist Hospital that Sunday (soonest I could get there) and was told it was a probable sprain with possible ligament damage. I saw my doctor, Dr. Charles M Day, yesterday, and he said it looked like a sprain and has ordered an MRI.
I cannot climb ladder or stand for long, and my knee is giving out, and I am walking with a limp. I have now fallen behind on bills and am without power as a result. The lack of medical services and poor medical attention in the jail is abhorrent. I have consulted but not picked an attorney yet, but want compensation for my injury and the loss of income which has resulted.

Now they have opened a claim, # 09-1978, which is being dealt with by a Mr. Phillips, but that doesn't fix my leg, give me back the time they stole, fix my business and get jobs back, or put my light and water back on.
The fact is the police, who were unqualified to deal with an ADHD child, and had no probable cause, should not have arrested me, and the next day the judge, James Ruth, who is a known as an arrogant ass by many people, was duty bound to acknowledge the exculpatory evidence, but did not and as such is guilty of judicial misconduct.
The prosecutor should have contacted DCF within 24 hours, but DCF was not contacted until my wife contacted them 10 days later t initiate an investigation. After we initiated the DCF investigation DCF found NO evidence of any abuse, in fact supported our allegations that the police got it wrong, and it still took over a week to clear the charges and release me, even though there was no evidence against me and all evidence exonerating me.
This caused me to suffer an injury where my knee is now sprained and I have torn ligaments, and can't climb a ladder or stand for long, so work if difficult, and cost all of our savings, and left us in the dark with no water or power.
There is nothing to give us relief as well... no one to help us or take responsibility for what was done to me and our family as a result.

In my clear view, Jacksonville is evil, hateful to the people who live there, city with no compassion or soul. Read the police report below...... see if you see probable cause, and understand that my son never said I hit him, but told them he got a bump while getting a spanking....
The police report number is 2009-819957. Read it and the statute and tell me where there was any probable cause to arrest. Ask why the police of prosecutor didn't bother to call DCF and why the courts and police and prosecutor ignored exculpatory evidence......(?)

Police also lied about what Alex said. He never told them the bump on his head was from being hit. He did say he got it when he was getting spanked, and did also explain it was self-inflicted, that he hit his head when trying to squirm away from a bottom spanking, hitting his head on his bed.
This was also explained in court to Judge Ruth, who ignored it, was rude, and who maybe doesn't deserve to be on the bench.
Further, sustaining an injury in jail and being ignored, having my right to legal access and medical care and being subjected to overcrowding is a clear violation of my rights, so now, as a result of poor police work, a corrupt court and judge, and lazy and malicious prosecutor my electric and water are off, my bills high, my resources exhausted, and my family left suffering... work was hard enough to come by, and now my knee is shot, if I could find enough work to play catch up again I'm still unable to work well because I got hurt from their abuse.
Sad thing is that I'm not alone in this. I am far from the only one who has been denied legal access or proper medical care. I may have a valid legal claim for damages, but how am I supposed to provide for my family now hurt with exhausted resources? I'd like someone to answer that for me, then tell my son why it is that we are in the dark with no water or electric....
